Senator Liz Boldon Carries Minnesota Debt Fairness Act Through Its First Committee Hearing

ST. PAUL, Minn. — On Thursday, March 14th, the Senate Commerce and Consumer Protection Committee heard Senate File 4065, otherwise known as the Minnesota Debt Fairness Act.

The legislation takes a number of approaches to reduce the burdens of medical debt on Minnesotans and their family members, including but not limited to:

  • Allowing patients to receive medically necessary care, regardless of outstanding medical debt
  • Prohibiting medical debt from being transferred to a spouse
  • Preventing medical debt from impacting Minnesotans’ credit scores
  • Limiting the percentage of a person’s paycheck that can be garnished to pay off debts
  • Protecting a base amount of a person’s bank accounts from collection, allowing debtors to cover basic necessities without falling into poverty
  • Modernizing property protections in bankruptcy cases

Senator Liz Boldon (DFL-Rochester), the bill’s author, released this statement following the conclusion of the hearing:

“We have heard countless heartbreaking stories from Minnesotans struggling with medical debt, through no fault of their own. Unlike a business or student loan, medical debt is not something anyone plans for, and it can be financially devastating for hardworking folks and their families. All they’re asking for is fairness in the repayment process. I want to sincerely thank Attorney General Ellison and his office for their diligent work on this life-changing legislation, and I look forward to seeing it pass this legislative session.”

The Minnesota Debt Fairness Act was referred to the Senate Judiciary and Public Safety Committee.
