Senator Matt Klein’s Commerce Budget Passes Senate Floor

ST. PAUL, Minn. — On Monday, May 6th the Senate took up SF4942 which included the Commerce and Consumer Protection supplemental budget led by Senator Matt Klein (DFL – Mendota Heights)

“This budget continues our important work this session to protect consumer rights and lower costs for Minnesotans,” said Senator Klein. Our bill will save Minnesotans money in their prescription drug costs, help them control and protect their personal data online, strengthen enforcement of laws to protect student loan borrowers, and save cities and their residents money by preventing copper wire theft.” 

The legislation contains the following provisions:

  • Addressing Copper Wire Theft: Cities across the state have been battling a wave of copper wire theft where thieves pry open access panels to streetlamps, traffic lights, HVAC systems, and more to access copper. This bill creates a licensure requirement for copper metal sellers through the Department of Commerce. The language received letters of support from 38 mayors across the state. (SF4455)
  • Minnesota Consumer Data Privacy Act: Provide Minnesotans with new rights over their personal data, including accessing data, deleting personal data, obtaining a copy of data, opting out of sale of data, and more. (SF 2915)
  • Lowering Prescription Drug Costs: 
    • In 1992 Congress established the 340B Drug Program which required drug manufacturers to provide discounts on drugs purchased by covered entities in exchange for their drugs being covered by Medicaid and Medicare. During the pandemic, many drug manufacturers stopped providing these discounts to providers who were partnering with community pharmacies and other retailers. 
    • These denials impact local hospitals and pharmacies operating on slim margins – particularly in Greater Minnesota. The provisions in this bill prohibit Rx manufacturers from the discriminatory practice of restricting, prohibiting, or interfering with the delivery of covered outpatient drugs to pharmacies under contract with a 340B covered entity. SF4942 incorporated the Agriculture, Commerce, and Energy supplemental budget bills. It passed the Senate on a vote of 36-30 and awaits passage in the House.
